In August, a federal appeals court on Wednesday upheld a federal law that bans gay conversion therapy for minors seeking to become straight. The ruling comes after a three-month stay of a federal trial court ruling that allowed the therapy to continue in Illinois.
The federal appeals court’s decision stems from a lawsuit filed in April by a Chicago lesbian, gay, bisexual and transgender (LGBT) group against the California-based group Dignity Health, a California nonprofit organization that offers counseling and “cures” for LGBT youth and adults with serious mental health challenges.
The plaintiffs argued that forcing the group to offer the therapy to minors constituted “exculpatory coercion” and violated their children’s right to “due process, equal protection, and freedom from cruel and unusual punishment.”
In July, the Ninth Circuit Court of Appeals upheld a district court’s ruling that the California organization, which had been barred by a state law from providing the therapy on behalf of minors, is not liable under the Americans with Disabilities Act for failing to provide services to those who need them.
